Agreement to Terms

By accessing our website or using our services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services.

Services Description

David Resurface provides pool resurfacing, Cool Deck coating, tile replacement, equipment installation, and related pool renovation services in the Phoenix metropolitan area. Specific services, pricing, and timelines are determined through individual quotes and service agreements.

Quotes and Estimates

  • All quotes are estimates based on visible conditions at the time of inspection
  • Quotes are valid for 30 days unless otherwise specified
  • Additional work discovered during the project may result in additional charges
  • We will communicate any changes to the scope or cost before proceeding

Service Agreement

Work begins only after a written agreement is signed and any required deposit is received. The service agreement will specify:

  • Scope of work to be performed
  • Materials to be used
  • Project timeline
  • Total cost and payment schedule
  • Warranty terms

Payment Terms

  • A deposit may be required to schedule work
  • Payment schedules are outlined in individual service agreements
  • We accept cash, check, and major credit cards
  • Late payments may incur additional fees as specified in the service agreement

Cancellation Policy

  • Cancellations must be made in writing
  • Cancellations made within 48 hours of scheduled work may forfeit the deposit
  • Once work has begun, cancellation may result in charges for work completed and materials ordered

Warranties

Warranty terms vary by service type and are specified in the service agreement. In general:

  • Workmanship warranties cover defects in our installation
  • Material warranties are provided by the manufacturer
  • Warranties do not cover damage from improper maintenance, accidents, or natural disasters
  • Warranty claims must be submitted in writing within 30 days of discovering the issue

Property Access and Preparation

The customer is responsible for:

  • Providing safe access to the work area
  • Removing furniture, plants, and personal items from the work area
  • Ensuring pets and children are kept away from the work area
  • Providing access to water and electricity as needed

Pool Draining and Care

  • We will drain and refill pools as part of resurfacing services
  • The customer is responsible for startup chemicals unless included in the agreement
  • Pools should not be used until we confirm the surface has properly cured
  • Follow all post-service care instructions to maintain warranty coverage

Limitation of Liability

To the maximum extent permitted by law, David Resurface shall not be liable for:

  • Indirect, incidental, or consequential damages
  • Delays caused by weather, material availability, or circumstances beyond our control
  • Pre-existing conditions not disclosed or discovered prior to work
  • Damage resulting from improper maintenance or misuse

Our total liability shall not exceed the amount paid for the services in question.

Intellectual Property

All content on our website, including text, images, logos, and design, is the property of David Resurface and protected by copyright laws. You may not reproduce, distribute, or use our content without written permission.

Website Use

When using our website, you agree not to:

  • Use the site for any unlawful purpose
  • Attempt to gain unauthorized access to our systems
  • Transmit malware or harmful code
  • Scrape or collect data without permission

Dispute Resolution

Any disputes arising from these terms or our services shall be resolved through:

We reserve the right to modify these terms at any time. Changes will be effective upon posting to our website. Continued use of our services after changes constitutes acceptance of the modified terms.

Severability

If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
